1. Definitions
Spirit Studios (also referred to as ‘Spirit’): is the company Spirit SSR Limited. Registered office address 79 Tib Street, Manchester, M4 1LS. Company Reg No: 3648503,
Student: the person entering into this agreement with Spirit Studios.
Premises: the location where courses are delivered.
Facilities: Equipment and / or rooms belonging to Spirit Studios that are used by the students.
Withdrawal or withdraw: The process by which a student leaves a course with no intention to return.
Deferral or defer: The process by which a student leaves a course with the intention of returning to the same course usually on a later intake.
Transfer: The process by which a student leaves a course with the intention of joining a different course at Spirit Studios.
Staff: A person working for Spirit Studios
2. Course types
2.1 Spirit Studios’ courses fall into one of six categories:
Academic courses: full or part time Foundation, Undergraduate or Postgraduate courses. These are validated by the University of Lancashire but delivered entirely at Spirit Studios.
Industry courses: part time evening courses that are usually privately funded by the student
Pro Tools courses certified by Avid: these courses are delivered to small groups and are typically two or three days in duration.
Summer Schools: short courses run over five consecutive weekdays during the summer period.
One-to-one tuition: bespoke tuition consisting of one or more sessions. The dates, times and content are set on an individual basis with the student.
Taster Courses: free courses run over a single day.
Some T&Cs will vary depending on the course type. Where this is the case, it will be clearly highlighted in this document.
3. Introduction
3.1 In addition to these terms and conditions, the student also agrees to observe and abide by Spirit Studios’ policy documents.
3.2 Should there be any change to our terms and conditions, students will be informed via their Spirit email, or the email address supplied during application if the course they applied for doesn’t require a Spirit email account
3.3 The provisions in this document prevail over any the previous terms and conditions.
4. Entering a contract
4.1 For academic courses, contracts are made between the student and the validating university. However students on academic courses studying at Spirit Studios are still subject to these terms and conditions in addition to those set out by the validating university.
4.2 For all other courses, students are deemed to have entered a contract with Spirit Studios as soon as payment (either an initial instalment or full fees) has been made and an application is accepted.
5. Application and enrolment
5.1 It is the student’s responsibility to ensure that every part of the application is completed accurately and truthfully. Failing to do so may result in the enrolment being delayed or cancelled.
5.2.1 All applications for undergraduate courses in the UK are made through UCAS.
5.2.2 Applications for postgraduate courses are made through the University of Lancashire’s application portal.
5.3.1 Applications for industry courses can be made via the Spirit Studios website, over the phone, or in person.
5.3.2 Industry courses can be paid for in monthly instalments or in one single full payment.
5.3.3 Unless otherwise stated applications are only accepted upon receipt of either the initial instalment or the full course fees.
5.3.4 Should Spirit Studios not run the course for any reason, the student will be entitled to a full refund of fees paid.
For Students payment in instalments
5.3.5 Once an application is received there will be a 14-day cooling off period during which the student is entitled to a full refund of fees paid.
5.3.6 If the course commences or is already running during the cooling off period, the student will be entitled to a refund of fees paid minus a £100 admin fee.
5.3.7 If the student elects to withdraw from the course more than 28 days before the start date, they will be entitled to a refund of fees paid minus a £25 admin charge.
5.3.8 It is possible to transfer to another course (except an Academic Course) as long as a request in writing is submitted by the student prior to the course commencement date. In this case the fees paid will transfer to the new course. Such a transfer will be free of charge on the first occasion. Any subsequent transfers will incur a £50 admin fee.
5.3.9 In all other circumstances, the fees paid are non-refundable.
For Students who paid the full fees upon application
5.3.10 Students who elect to pay the full course fees at application will receive a 10% discount. Once the payment has been made, there will be a 14-day cooling off period during which the student is entitled to a full refund of fees paid.
5.3.11 If the student elects to withdraw from the course, more than 28 days before the start date, they will be entitled to a refund of fees paid minus a £25 admin charge.
5.3.12 If the student wishes to withdraw from the course less than 28 days past the start date, they will be entitled to a full refund of fees paid minus the fee for one month’s instalment.
5.3.13 It is possible to transfer to another industry course as long as a request in writing is submitted by the student prior to the course commencement date. In this case the fees paid will transfer to the new course. If the new course has a higher fee, the student will be required to make up the difference. If the new course has a lower fee, the balance will be refunded. Such a transfer will be free of charge on the first occasion. Any subsequent transfers will incur a £50 admin fee.
5.3.14 In all other circumstances, the fees paid are non-refundable.
5.4.1 Applications for Pro Tools courses can be made via the Spirit Studios website, over the phone, or in person and should be made at least 14 days before the start date.
5.4.2 Unless otherwise stated, places can be reserved only on receipt of the full course fees.
5.4.3 Once an application is received there will be a 14-day cooling off period during which the student is entitled to a full refund of fees paid.
5.4.4 These courses require a minimum number of students to run. If this number has not been reached 14 days before the start date, Spirit Studios will transfer the student to a future intake. Alternatively, the student may request a full refund of the fees paid.
5.4.5 Under any other circumstances the course fees are not refundable.
5.5.1 Applications for Summer schools can be made via the Spirit Studios website, over the phone or in person.
5.5.2 Unless otherwise stated, places can be reserved only on receipt of the full course fees.
5.5.3 Once an application is received there will be a 14-day cooling off period during which the student is entitled to a full refund of fees paid.
5.5.4 If the course commences or is already running during this cooling off period the student will not be entitled to a refund.
5.5.5 Should Spirit Studios not run the course for any reason, the student can transfer to another Summer School (subject to availability) free of charge or request a full refund of the fees paid.
5.5.6 It is possible to transfer the fees paid when applying to another summer school or industry course as long as a request in writing is submitted by the student prior to the course commencement date. Such transfer will be free of charge on the first occasion. Any subsequent
transfers will incur a £50 admin fee.
5.5.7 In all other circumstances, the fee paid when applying is non-refundable.
5.6.1 Applications for one-to-one tuition must be made at least 21 days prior to the first session.
5.6.2 Unless otherwise stated, places can be reserved only on receipt of the full fees.
5.6.3 If a one-to-one session is cancelled by the student seven or more days before the start of the session, the student is entitled to a refund of the fees for the cancelled session minus a £50 admin fee.
5.6.4 If a one-to-one session is cancelled by the student less than seven days prior to the session, the student is not entitled to a refund for that session.
5.6.5 Any one-to-one session can be rescheduled by the student providing they give at least seven days notice. Each session can only be rescheduled by the student on one occasion. Any subsequent requests for reschedules will be treated as cancellations.
5.6.6 On rare occasions, it may be necessary for Spirit Studios to reschedule a one-to-one session. In such cases Spirit Studios will make every effort to inform the student at the earliest opportunity and will work with the student to find an alternative slot that suits them. If this is not possible, the student shall be entitled to a refund of the fees for that session.
5.6.7 If the student has paid for multiple one-to-one sessions, each individual session will be subject to the terms above. The cost of each session will be calculated by total fees paid ÷ total hours booked x hours of cancelled session.
5.7.1 Applications for taster courses can be made via the Spirit Studios website, over the phone or in person.
5.7.2 Unless otherwise stated, places can be reserved only on receipt of a small deposit.
5.7.3 Once an application is received there will be a 14-day cooling off period during which the student is entitled to a full refund of the deposit.
5.7.4 The deposit will be refunded to the student on the day they attend the course.
5.7.5 If the student does not attend the course, the deposit will not be refunded.
5.5.6 Should Spirit Studios not run the course for any reason, the deposit will be refunded.
6. Course fees
6.1.1 All course fees are indicated on Spirit Studios website. Course fees do not include personal equipment costs.
6.2.1 For academic course fees, terms and conditions are set by the validating university and the student loan company (Student finance overview), and all fees are paid directly to the university. Please visit the university website for details.
6.3.1 Unless otherwise stated, fees for industry courses can be paid in a single payment, or by equal monthly instalments throughout the student’s enrolment on the course. All course fees are payable in advance. Students are not entitled to a refund of any fees if they are withdrawn from the course by Spirit Studios for disciplinary reasons.
6.3.2 Once an application has been accepted any subsequent price increase for the course that may occur will not apply to the student.
For Students payment in instalments
6.3.2 All instalment payments are payable in advance. If the student withdraws from course for any reason, instalments are only payable up to and including the final month they attended.
6.3.3 Late payment of an instalment will result in access to Spirit Studios facilities being withdrawn and one to one sessions being suspended until all outstanding fees are received. If a student’s course fees are overdue by two or more weeks, the student will be suspended from the course until all outstanding fees are received. In the case of repeated late payments or payments that are overdue by more than one month, Spirit Studios reserves the right to remove the student from the course permanently. The student should be aware that Spirit Studios may also exercise further rights, for example (1) to prevent enrolment onto other courses delivered by Spirit Studios , or (2) to exercise its rights not to award a certificate where
any fees are outstanding.
6.3.4 If late instalment fees are still due at the time of the student leaving a course, whether by the course ending or by termination by either party, these fees are still liable for payment.
6.3.5 Course fees are payable irrespective of the student’s attendance.
6.3.6 Students are not entitled to a refund of any fees paid if they withdraw from the course before completion, unless this is on medical grounds and sufficient evidence such as a doctor’s letter is provided. Under these circumstances a refund may be given at the discretion of Spirit Studios. Students must inform Spirit Studios in writing if they wish to withdraw from
the course.
6.3.7 If the student wishes to defer their course, there will be no instalments payable during the period of deferral.
Students who paid the full fees in advance
6.3.8 If a student pays the full course fees at application or within two weeks of the course start date, they will receive a 10% discount.
6.3.9 If the student wishes to withdraw from the coursebut less than 28 days past the start date, they will be entitled to a full refund of fees paid minus the fee for one month’s instalment.
6.3.10 If the student withdraws from the course on medical grounds and sufficient evidence such as a doctor’s letter is provided a full or partial refund may be given at the discretion of Spirit Studios. In such cases the decision of Spirit Studio is final.
6.3.11 If the student wishes to defer their course, there will be no extra fee payable. This is on the assumption that the student resumes their studies at roughly the same point as they left. If the student wishes to repeat sections of the course, an extra fee may be chargeable. This fee will be negotiated between Spirit Studios and the student.
6.3.12 In all other circumstances, the fees paid are non-refundable.
6.4.1 Course fees are payable irrespective of the student’s attendance.
6.4.2 Students are not entitled to a refund of any fees if they withdraw from the course before completion, unless this is on medical grounds and sufficient evidence such as a doctor’s letter is provided. Under these circumstances a refund may be given at the discretion of Spirit Studios. Students must inform Spirit Studios in writing if they wish to withdraw from
the course.
6.4.4 Students are not entitled to a refund of any fees if they are withdrawn from the course by Spirit Studios for disciplinary reasons.
6.5.1 Course fees are payable irrespective of the student’s attendance.
6.5.2 Students are not entitled to a refund of any fees if they withdraw from the course before completion, unless this is on medical grounds and sufficient evidence such as a doctor’s letter is provided. Under these circumstances a refund may be given at the discretion of Spirit Studios. Students must inform Spirit Studios in writing if they wish to withdraw from
the course.
6.5.3 Students are not entitled to a refund of any fees if they are withdrawn from the course by Spirit Studios for disciplinary reasons.
6.6.1 Course fees are payable irrespective of the student’s attendance.
6.7.2 Students are not entitled to a refund of any fees if they withdraw from a session before completion, unless this is on medical grounds and sufficient evidence such as a doctor’s letter is provided. Under these circumstances a refund may be given at the discretion of Spirit Studios.
6.7.3 Students are not entitled to a refund of any fees if they are asked to leave the premises by Spirit Studios for disciplinary reasons.
7. Contact details
7.1 The student has a responsibility to keep Spirit Studios fully informed of their current contact details. Should a student fail to do so, Spirit Studios cannot be held responsible for any subsequent problems encountered by the student relating to incorrect data.
8. Change policy
8.1 Spirit Studios will make every effort not to change the dates and times of a course. However on occasions this may prove necessary and so we reserve the right to make changes. When this is the case, Spirit Studios will provide as much notice as possible to all students who have applied for or who are enrolled on the course.
8.2 Spirit Studios’ courses and facilities are constantly reviewed and updated. Whenever a significant change is planned, Spirit Studios will inform the students giving as much notice as possible.
Examples of significant changes include:
● A new form of assessment
● A new module
● Decommission / introduction of a facility such as a recording studio
● The rescheduling of a lesson
8.3 If the change is considered insignificant, Spirit Studios would not normally inform the students. Examples of insignificant changes include:
● Replacement of a piece of equipment that would have no effect on the student’s training
● Updates to course materials
9. Student code of conduct
9.1 Students are expected to abide by Spirit Studios’ Student Conduct Regulations. This document can be downloaded via our website. The student must comply with any additional requirements which may be imposed by any regulatory bodies or accreditation schemes for the specific fields of study.
10. Access to the premises
10.1 Spirit Studios reserves the right to refuse access to the premises to unauthorised visitors or anyone found to be in serious breach of Spirit Studios’ rules and regulations.
11. Liability
11.1 Spirit Studios (including its staff) shall have no liability to the student for any loss, damage, costs or expenses arising during the course unless it is caused directly by Spirit Studios (including its staff). Furthermore, Spirit does not accept responsibility or liability for any form of loss or damage to the student’s personal property.
11.2 Spirit Studios (including its staff ) shall have no liability for any form of injury to the student unless it is caused directly by Spirit Studios. (including its staff).
11.3 Spirit Studios will not be liable for failure or delay in providing its services if such failure or delay is the result of circumstances beyond its reasonable control. Such circumstances include but are not limited to, extreme weather, industrial action, external internet disruption, pandemics, public unrest and government restrictions.
12. Intellectual property
12.1 Spirit Studios’ IP regulations can be found online, along with all other policy documents. This policy applies to anyone studying with Spirit Studios.
12.2 Students on academic courses should also take note of the validating university’s IP Policy.
12. Data protection
13.1 Spirit Studios ensures that appropriate security measures are taken against unlawful or unauthorised processing of personal data and against the accidental loss of, or damage to, personal data. The UK General Data Protection Regulation requires Spirit Studios to put in place procedures and technologies to maintain the security of all personal data from the point of collection to the point of destruction. Maintaining data security means, amongst other things, guaranteeing the confidentiality, integrity and availability of the personal data.
